1. Definitions

In these Terms & Conditions:

  • "Service" refers to property rental services provided by Orchid Manor
  • "Property" means any residence listed and managed through our services
  • "Guest" or "You" refers to the individual or entity booking a property
  • "We," "Our," or "Us" refers to Orchid Manor
  • "Agreement" means the rental contract formed upon booking confirmation
  • "Booking Period" refers to the confirmed rental dates

2. Acceptance of Terms

By inquiring about, viewing, or booking properties through Orchid Manor, you agree to be bound by these Terms & Conditions. If you do not accept these terms, please do not proceed with property bookings.

These terms constitute a legally binding agreement between you and Orchid Manor under Thai law. Booking confirmation indicates your acceptance of all terms outlined herein.

You must be at least 18 years of age and possess legal capacity to enter into contracts under Thai law to use our services.

3. Property Rental Services

3.1 Service Description

Orchid Manor provides access to residential properties in Bangkok featuring natural materials and traditional Thai craftsmanship. Our services include property selection assistance, viewing coordination, booking management, and guest support during stays.

3.2 Property Information

We provide detailed information about each property including construction materials, architectural features, amenities, and location. While we strive for accuracy, property descriptions are provided for informational purposes. We recommend property viewings before booking to ensure the residence meets your requirements.

3.3 Service Availability

Properties are subject to availability. We reserve the right to decline bookings if properties are unavailable or if we determine that requested usage may not be appropriate for specific residences.

4. Booking Process

4.1 Inquiry and Viewing

Property inquiries may be submitted via our website contact form, email, or telephone. We will respond within 48 hours during business hours. Property viewings can be arranged by appointment and typically last 60-90 minutes.

4.2 Booking Confirmation

Bookings are confirmed upon receipt of the required deposit and signed rental agreement. Confirmation will be provided in writing via email. Bookings are not finalized until confirmation is issued.

4.3 Rental Agreement

Each booking requires a signed rental agreement specifying property details, booking dates, rates, payment terms, and usage guidelines specific to the selected property. The rental agreement forms part of these Terms & Conditions.

5. Payment Terms

5.1 Pricing

Property rates are quoted in Thai Baht (฿) and include property access, utilities, and basic amenities. Additional services such as housekeeping or private chefs are quoted separately.

5.2 Payment Schedule

A deposit of 30% of the total booking value is required to secure your reservation. The remaining balance is due 14 days prior to the booking start date. Failure to pay the balance by the due date may result in booking cancellation.

5.3 Payment Methods

We accept payment via bank transfer and major credit cards. All payment transactions are processed securely. Transaction fees, if applicable, will be clearly stated before payment processing.

5.4 Taxes

Quoted rates do not include applicable Thai taxes. Value Added Tax (VAT) and other relevant taxes will be added to the final invoice as required by Thai law.

6. Cancellation and Refunds

6.1 Guest Cancellation

Cancellation policies vary by property and booking period:

  • Cancellations 30+ days before arrival: 80% refund of deposit
  • Cancellations 14-29 days before arrival: 50% refund of deposit
  • Cancellations less than 14 days before arrival: No refund
  • Full balance payments are non-refundable

6.2 Force Majeure

If bookings cannot proceed due to circumstances beyond our reasonable control (natural disasters, government restrictions, property damage), we will work with guests to reschedule or provide refunds at our discretion.

6.3 Our Cancellation Rights

We reserve the right to cancel bookings if properties become unavailable or if we determine continuation of the booking would compromise property integrity or other guests' experiences. Full refunds will be provided in such cases.

7. Guest Responsibilities

7.1 Property Care

Guests must treat properties with appropriate care, respecting natural materials and architectural features. Properties featuring wood, stone, and bamboo elements require specific handling as outlined in property-specific guidelines provided at check-in.

7.2 Prohibited Activities

The following activities are prohibited:

  • Smoking inside properties (unless specifically designated areas exist)
  • Events or gatherings exceeding agreed occupancy limits
  • Illegal activities of any kind
  • Damage to or removal of property furnishings or fixtures
  • Subletting or unauthorized third-party access
  • Activities that may damage natural materials or finishes

7.3 Compliance with Laws

Guests must comply with all applicable Thai laws and local regulations during their stay, including noise ordinances and waste disposal requirements.

7.4 Occupancy Limits

Properties have specified maximum occupancy limits. Exceeding these limits violates the rental agreement and may result in immediate termination of the booking without refund.

8. Property Access and Security

8.1 Check-in and Check-out

Standard check-in time is 3:00 PM and check-out time is 11:00 AM. Alternative arrangements may be available by prior agreement. Early check-in or late check-out requests are subject to availability and may incur additional charges.

8.2 Security Deposit

A refundable security deposit may be required, amount determined by property type. The deposit will be refunded within 14 days of check-out if no damages or violations occurred during the stay.

8.3 Property Inspections

We reserve the right to inspect properties with 24 hours' notice or immediately in case of emergency situations or suspected violations of these terms.

9. Disclaimers

9.1 Natural Material Characteristics

Properties feature natural materials that age and respond to environmental conditions. Wood grain variations, stone color differences, and material texture changes are inherent characteristics, not defects. We do not guarantee uniformity in natural material appearances.

9.2 Service Availability

While we strive to maintain properties in good condition, we cannot guarantee uninterrupted availability of all amenities. Utilities and services may occasionally be affected by circumstances beyond our control.

9.3 No Professional Advice

Information provided about properties, materials, or construction techniques is for educational purposes only and does not constitute professional architectural, structural, or construction advice.

10. Limitation of Liability

To the maximum extent permitted by Thai law, our liability for any claims arising from property rentals is limited to the total amount paid for the specific booking in question.

We are not liable for indirect, consequential, or incidental damages including lost profits, business interruption, or personal injury except where caused by our gross negligence or willful misconduct.

Guests are responsible for obtaining appropriate travel insurance covering personal belongings, medical expenses, and trip cancellation.

11. Indemnification

You agree to indemnify and hold harmless Orchid Manor, property owners, and associated parties from claims, damages, or expenses arising from your use of properties, violations of these terms, or violations of any applicable laws or third-party rights.

12. Termination

We reserve the right to terminate bookings immediately without refund if guests violate these terms, damage properties, disturb neighbors, or engage in illegal activities.

Guests may terminate bookings subject to the cancellation policy outlined in Section 6.

13. Dispute Resolution

13.1 Governing Law

These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any disputes will be subject to the exclusive jurisdiction of Thai courts.

13.2 Informal Resolution

Before initiating formal proceedings, parties agree to attempt good-faith resolution through direct communication. Disputes should be submitted in writing to [email protected].

14. General Provisions

14.1 Entire Agreement

These terms, together with property-specific rental agreements, constitute the entire agreement between you and Orchid Manor regarding property rentals.

14.2 Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

14.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent.

15. Changes to Terms

We may update these Terms & Conditions periodically. Changes will be posted on our website with an updated effective date. Material changes will be communicated to guests with existing bookings.

Bookings made before term changes will be governed by the terms in effect at the time of booking confirmation.
